SEATING CAPACITY ILLINOIS LIMOUSINE LLC adheres to strict seating capacity limits for the safety and comfort of our passengers. Please note the following guidelines regarding passenger and luggage capacity: * Sedan: Maximum of two (2) passengers with a maximum of two (2) medium-sized suitcases and two (2) carry-on bags. * SUV: Maximum of six (6) passengers with a maximum of six (6) large suitcases and six (6) carry-on bags. * Sprinter: Capacity for fourteen (14) to fifteen (15) passengers with capacity for fourteen (14) to fifteen (15) large suitcases. Carry-on luggage can typically be accommodated within the passenger area, provided it does not obstruct pathways or seating. * Limousine (Stretch): Capacity for eight (8) to ten (10) passengers. For safety reasons, storing luggage of any kind inside the passenger cabin of stretch limousines is strictly prohibited. Luggage capacity is limited to the trunk, which can typically accommodate a maximum of two (2) large suitcases and two (2) medium-sized carry-on bags. Attempting to store luggage within the passenger area poses a significant risk of bodily harm in the event of sudden braking or an accident. * 40-55 Passenger Bus: Capacity for forty (40-55) passengers with luggage capacity for approximately fourteen (14-20) large suitcases stored in designated compartments and up to thirty-nine (45) small carry-on bags in the overhead compartments. It is the customer's responsibility to select a vehicle type that adequately accommodates their passenger and luggage needs based on these guidelines. ILLINOIS LIMOUSINE LLC reserves the right to refuse service if the number of passengers or luggage exceeds the stated capacity for the booked vehicle, as this may compromise safety and violate regulations. No refunds will be issued in such cases. Customers with excessive luggage are advised to book a larger vehicle or make alternative arrangements for their belongings. MEDIATION CLAUSE In the event of any dispute arising from or relating to this Agreement that cannot be resolved through direct negotiation, the parties agree to first attempt in good faith to settle the dispute by mediation before resorting to arbitration, litigation, or any other dispute resolution procedure. Parties shall jointly select a qualified neutral mediator within 7 days of a written request for mediation by either party. If the parties are unable to agree on a mediator within this timeframe, they shall request the American Arbitration Association (AAA) to appoint a mediator in accordance with its mediation rules. The mediation shall be held in Cook County, Illinois, unless otherwise mutually agreed. The parties agree to participate in the mediation in good faith and share the costs of the mediator equally. If the parties are unable to reach a resolution through mediation within 30 days from the date the mediator is selected, either party may then pursue other available legal remedies. Evidence Submission for Mediation: * For disputes primarily concerning Damages, parties shall submit all relevant documentation and evidence (e.g., repair estimates, invoices, photos) to the mediator and the opposing party within 14 days of the mediator's selection. * For disputes primarily concerning Service Quality or Chauffeur Conduct, parties shall submit all relevant documentation (e.g., communication records, incident descriptions, booking details) to the mediator and the opposing party within 14 days of the mediator's selection. Revisions to Terms and Conditions Illinois Limousine LLC reserves the right, in its sole discretion, to modify or replace these Terms and Conditions at any time. We will indicate the date of the last revision at the top or bottom of this document. If a revision is material (as determined in our sole discretion), we will make reasonable efforts to provide at least 30 days' notice prior to the new terms taking effect. Notice may be provided by posting the updated Terms and Conditions on the Illinois Limousine LLC website, sending an email notification to the address associated with your account or booking, or via other appropriate means. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the website and the Service. Illinois Limousine LLC - Limitation of Liability Regarding Passenger Safety, Movement, and External Factors Illinois Limousine LLC is committed to providing safe and reliable transportation services. However, it is important for all passengers to understand and acknowledge the inherent risks associated with transportation, including factors beyond our direct control. By using our services, you agree to the following limitations of liability: Assumption of Risk: Passengers acknowledge and understand that getting into and out of a vehicle involves physical movement and carries a risk of slips, trips, and falls, which could result in injury. Similarly, movement within a moving vehicle, even with safety precautions, can also present risks. * Example: A passenger trips while stepping out of the limousine onto a curb and twists their ankle. This clause highlights that such incidents are part of the inherent risks of transportation. Passenger Responsibility: Passengers are responsible for exercising reasonable care and caution when entering, exiting, and moving within the limousine. This includes, but is not limited to: * Being aware of their surroundings. * Using available handholds or other safety features within the vehicle. * Requesting assistance from the driver if needed for entry or exit. * Remaining seated while the vehicle is in motion, unless instructed otherwise by the driver. * Securing their belongings to prevent them from shifting during transit. * Example: A passenger stands up while the limousine is turning and loses their balance, bumping their head. This clause emphasizes the passenger's responsibility to remain seated for their safety. Limitation of Liability: To the fullest extent permitted by applicable law, Illinois Limousine LLC, its owners, employees, and agents shall not be liable for any injuries sustained by passengers as a direct or indirect result of: * Falling, slipping, or tripping while entering or exiting the vehicle. * Injuries sustained due to sudden movements of the vehicle, including but not limited to braking, acceleration, or turning, unless such movements are caused by the gross negligence or willful misconduct of the driver. * Injuries resulting from a passenger's failure to exercise reasonable care and caution while inside or around the vehicle. * Failure to follow instructions provided by the driver regarding safety and conduct within the vehicle. * Driver Qualifications and Subcontractor Use: Illinois Limousine LLC prioritizes passenger safety by employing rigorously vetted and professionally trained drivers who are required to hold a valid chauffeur's license in the State of Illinois, a process that includes a mandatory background check conducted by state authorities. To accommodate periods of high demand or specific vehicle requests, services may occasionally be provided by carefully selected independent subcontractors who also meet all applicable licensing and regulatory requirements, including background checks. Passengers understand and agree that when services are provided by a subcontractor, the subcontractor is solely responsible for their operation of the vehicle, and Illinois Limousine LLC's liability for their actions is limited to the extent permitted by law for independent contractors. * Example: A passenger doesn't use the handrail while getting into the limousine and falls, injuring their wrist. This clause limits our liability in such a scenario where reasonable care wasn't taken. Limitation of Liability for Bodily Harm Caused by External Factors: To the fullest extent permitted by applicable law, Illinois Limousine LLC, its owners, employees, and agents shall not be liable for any bodily harm, injury, or death to passengers directly or indirectly caused by events or conditions beyond our reasonable control, including but not limited to: * Severe Weather: Injuries sustained due to weather conditions such as ice, snow, heavy rain, or high winds, even if these conditions affect travel or require passengers to navigate them. * Example: A passenger slips and falls on an icy patch while walking from the limousine to their destination during a winter storm. * Acts of Third Parties: Injuries sustained as a result of the actions or negligence of third parties, including but not limited to accidents caused by other vehicles, pedestrians, or other individuals not affiliated with Illinois Limousine LLC. * Example: The limousine is involved in an accident caused solely by the negligence of another driver, and a passenger in our vehicle sustains injuries. * Force Majeure Events: Events such as natural disasters, civil unrest, acts of terrorism, or other unforeseen circumstances that prevent the safe operation of the vehicle or directly cause harm to passengers. * Example: A sudden and severe hailstorm causes damage to the limousine and results in minor injuries to a passenger. This limitation specifically applies unless such harm is a direct and foreseeable consequence of the gross negligence or willful misconduct of Illinois Limousine LLC, its owners, employees, or agents. Additional Liability Clauses: * Severability: If any provision of this Limitation of Liability is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall remain in full force and effect. * Example: If a court finds one specific sub-point within the "Limitation of Liability" section to be unenforceable, the rest of the liability clause will still be valid. * Limitation of Liability for Defamation: To the fullest extent permitted by law, Illinois Limousine LLC, its owners, employees, and agents shall not be liable for any claims of defamation arising from statements made by its employees or representatives in the course of providing services, unless such statements are proven to be made with malicious intent and are unrelated to the provision of transportation services. This clause is not intended to limit liability for defamatory statements made by the company itself with malicious intent. * Example: A dispatcher, during a phone call about a booking, makes a false and malicious statement about a passenger to another client. This clause aims to protect the company in most other scenarios of employee communication. * Limitation of Liability for Consequential Damages: To the fullest extent permitted by applicable law, Illinois Limousine LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of our services or the inability to use our services, even if Illinois Limousine LLC has been advised of the possibility of such damages. This includes, but is not limited to, missed flights, lost business opportunities, or emotional distress. * Example: A passenger is late for a crucial business meeting due to heavy traffic (an external factor), and as a result, loses a significant deal. This clause limits our liability for such indirect financial losses. * Governing Law: This Limitation of Liability shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. * Example: Any legal disputes regarding this liability clause will be resolved according to the laws of Illinois. Important Considerations: * Passenger Insurance: Passengers acknowledge that Illinois Limousine LLC's insurance coverage is primarily for the operation of its vehicles and liability arising from its direct negligence. Passengers are responsible for obtaining their own personal health and accident insurance to cover any injuries they may sustain while using our services, regardless of fault. * First Aid and Emergency Assistance: Illinois Limousine LLC drivers are not trained medical professionals and are not qualified to assess or provide medical treatment for injuries. In the event of an accident or medical emergency, our drivers are instructed to promptly contact the appropriate authorities (police, fire department, paramedics) and, if safe to do so and at the passenger's request or as directed by emergency personnel, can transport passengers to the nearest medical facility. By booking and utilizing the services of Illinois Limousine LLC, you acknowledge that you have read, understood, and agree to this entire Limitation of Liability, including these additional considerations.
